Policy Pulse - Env-A 1400 RTAP List Amendments
On January 8, 2026, the New Hampshire Department of Environmental Services (NHDES) finalized revisions to the list of Regulated Toxic Air Pollutants (RTAPs) and select emission limits in Table 1450-1 of NHDES rule part Env-A 1400. A few things to know about the rule and the recent revision:
Only a select number of RTAPs and emission limits changed, and other rule components, including the list of exemptions and methods of demonstrating compliance, remained unchanged.
Any non-exempt emission device that emits one or more RTAP in New Hampshire is subject to this rule, whether the emission device requires a permit or not.
Combustion devices that combust virgin petroleum products or other exempt fuel (e.g., diesel-fired emergency generators, natural-gas-fired boilers) are not subject to this rule.
Sources subject to the rule have 90 days to update their compliance demonstration. If a new permit is required or an existing permit is required to be modified, a compliance plan and permit application is required to be submitted by April 8, 2026.
