Problem Nature and Extent

The Duprey Company, LLC proposed to acquire an underdeveloped distressed site for beneficial redevelopment.  The redevelopment process would result in job creation, city housing development and increased business office space in the downtown Concord area. Regulatory concerns included the presence of historic “urban fill.”

In 2009, prior to the property transfer, Aries conducted a Phase I Environmental Site Assessment (ESA) in accordance with the current ASTM Standard E 1527, which identified recognized environmental conditions (RECs) at the site. Due to the pending property transfer, Aries conducted an expedited Phase II ESA in accordance with the current ASTM Standard E 1903.  Aries worked closely with the client and the New Hampshire Department of Environmental Services (NHDES) to ensure that regulatory requirements and construction deadlines were met.

Solution

  • To facilitate swift site redevelopment, Aries recommended a cost-saving remediation strategy of completing the urban fill soil removal work under a Soil and Material Management Plan (SMMP).
  • Aries negotiated expedited NHDES reviews to prevent project construction delays.
  • NHDES issued a “Certificate of No Further Action” for Aries’ SMMP, which avoided site redevelopment delays.
  • In 2011, construction was completed for a five-story mixed office and retail building by the Duprey Company, LLC and an affordable rental housing complex by CATCH Neighborhood Housing, a 501(c)3, non-profit organization offering a full spectrum of housing services in Merrimack County, New Hampshire.
